3.1. Service Availability

The pages of this website are publicly accessible, free, and open.

You must use the Website in accordance with the Law.

Therefore, the owner of this Website cannot assume any responsibility arising from the misuse, improper use, incorrect, or unlawful use of the Website and/or its content.

Merely accessing the website www.moanui.com/en does not imply the establishment of any commercial relationship between MOANUI and the user.

When placing an order through this website, you declare that you are over 14 years old. Children under fourteen years old cannot give their consent for the processing of personal data on their own, and therefore, the sale to minors under 14 years old is not allowed. They can only access through the consent of their legal representatives (parents or guardians, as appropriate) who may do so on their behalf.

The products offered are distributed exclusively in Germany, Austria, Belgium, Denmark, Spain (Peninsula and Balearic Islands), Finland, France, Netherlands, Italy, and Sweden. We do not ship to the Canary Islands, Ceuta, Melilla, or countries not mentioned above.

MOANUI has made an effort to display the colors of the products as accurately as possible.

However, the color of the products shown on the screen may vary depending on the quality of your computer monitor. In this regard, MOANUI cannot guarantee that the colors appearing on your monitor will accurately match reality.

The legal warranty of all our products is as defined by law, and its terms will always be respected by MOANUI.

If the item has a defect or there has been an error in the shipment, you can return or exchange it at any of the assigned Courier offices or Post Offices mentioned in the return process.

Once the error or defect has been verified, we will refund the full amount paid.

3.3. Purchase Procedure

You can make your purchase online either by creating a customer account through the section (MY ACCOUNT), filling in all the data requested by the system, or as a GUEST, so you don’t need to be registered to buy at MOANUI. However, if you register, you can streamline the process in your future purchases and it will be easier for you to identify yourself when picking up the order.

If you make your purchase as a GUEST, the data you provide will be used exclusively to inform you about the status of your web order.

In either case, the personal data you provide will be processed in accordance with what is established in our Privacy Policy. Additionally, you can access, at any time, the personal data provided and the information on orders placed as long as you have created a web account.

MOANUI reminds its customers that personal data must be provided accurately to avoid confusion or incidents in shipping. Additionally, if you accept or request it, you will receive personalized commercial communications adapted to your profile by email and/or SMS.

If you have a web account, we recommend that you access it to make your purchases as this will facilitate tracking your orders, and your purchases will be recorded in your customer history.

The shopping basket will contain the photo, the name of the item, chosen color, size, units, and price (taxes included).

The price quoted includes transportation.

Before placing the order, you will be presented with a summary of it identifying the product(s) added to the shopping basket, as well as its total price (transportation and taxes included) with each of the breakdowns, and also the shipping details. If everything is correct, you must confirm the order by clicking on the button labeled ‘Confirm payment’.

By clicking on the “Confirm payment” button, you acknowledge that you are obligated to pay for the product(s) so that the order can be generated automatically and prepared.

Once the order is placed, you will be provided with a purchase locator number through the Website itself so that you can track it at any time and from your device.

Likewise, an automatic message will be sent to the email address provided stating the DEFINITIVE ORDER NUMBER, a detailed description of it, and including the personal data provided.

This message is the ORDER CONFIRMATION. The non-receipt of this “order confirmation” message may be due to some transient communication problem on the network or to a writing error in the provided email address.

In both cases, MOANUI recommends that if you do not receive this Order Confirmation email, you contact our Customer Service, click here to do so.

3.4. Order Cancellation

Once the order is finalized and paid for, you can only cancel it if you have done so through your customer account and it is in the “In Process” status.

In these cases, you can cancel the order by accessing it through your account as long as the order has not yet been prepared by our warehouse. If the status of the order is “In Process”, you can cancel it, but if that status has been modified, it is because our warehouse is already preparing the order and it cannot be canceled.

If you have made your purchase as a GUEST or if you have requested in-store pickup as the shipping method, we will not be able to cancel your order, so when you receive it, you can exchange or return it.

3.5 Product Availability

All orders are subject to product availability.

If at the time of placing the order, MOANUI detects the lack of stock in its warehouses for any of the products included in it, you will be notified immediately via email.

In addition, the amount charged for the item not shipped will be refunded to the customer in the following days (maximum 30 days) by the same payment method used in the purchase.

3.6. Acceptance of the Order

All orders are subject to our acceptance.

No contract will exist between us in relation to any product until your order has been expressly accepted by us. If your purchase request is not accepted, the amount of the order will be fully refunded to you.

MOANUI may not accept an order placed for the following reasons:

  • In case of a technical error and/or typographical error in the prices or in the rest of the product data contained on the Website when the order was placed.
  • Due to lack of availability as described in point 3.5 of these conditions.
  • When security systems indicate that the order may be fraudulent.
  • When there are reasons to believe that the customer is under 14 years old.
  • In the event of a cyber attack, virus, or any event beyond reasonable control (force majeure) of MOANUI. In any case, MOANUI will inform you of the non-acceptance of the order, and the amounts that have been paid will be fully refunded to you.

When MOANUI accepts the order and it has been prepared in our warehouse, you will be notified through a new email confirming that the order has been shipped, Confirmation of shipment email.

Therefore, the contract in relation to the requested product(s) will be considered concluded when MOANUI sends you its Shipping Confirmation.

The Contract will only concern the product(s) confirmed in the Shipping Confirmation.

MOANUI will not be obliged to supply any product(s) that have not been confirmed. Please note that the Shipping Confirmation will be sent to you within a maximum period of 48 hours from when you placed the order, a period that may vary due to exceptional circumstances or force majeure causes.

4.PRICE AND PAYMENT

4.1. Payment and Currency

The prices on the Website are displayed in Euros.

The prices of products may change at any time, but any potential changes will not affect orders for which MOANUI has sent its Order Confirmation.

4.2. Value Added Tax

All product prices listed on this Website include VAT at the applicable rate at any given time.

4.3. Invoicing

When placing a web order, you give your express consent to receive the invoice in electronic format.

The invoice generated by the system will be sent to you via email along with the order shipment confirmation and will be a simplified invoice, with the details set in your Billing Address.

If you require a full invoice, you will need to contact our Customer Service.

4.4. Payment Methods

MOANUI only accepts payments made through credit or debit card via https://stripe.com/es/payments

The order is not automatically generated until payment is made, so payment is necessary to receive the order confirmation and for our warehouse to prepare it.

MOANUI accepts payment for purchases made through the Website/Application with the following credit or debit cards: Visa and Mastercard via the platform https://stripe.com/es/payments.

4.5. Payment Security

In order to provide maximum security to the payment system, MOANUI uses secure payment systems from top-tier financial entities in e-commerce.

In this regard, confidential payment data is transmitted directly and encrypted (SSL) to the corresponding financial entity. For payment with Visa and MasterCard cards, MOANUI only accepts Secure Electronic Commerce (CES) transactions, including, if applicable, the international 3D Secure protocol distinguished by the Verified by Visa and MasterCard SecureCode logos.

Secure Electronic Commerce is an initiative whose basic principle is to ensure security in Internet transactions. When making payment through the secure payment gateway, the system will automatically verify that the credit card is activated for Secure Electronic Commerce.

As a complementary measure to the ‘Secure Payment’ system and with the aim of collaborating in the prevention of fraud through the Internet, MOANUI reserves the right to verify the personal data provided by the customer, as well as to take appropriate measures (including order cancellation) to ensure that the purchased merchandise is delivered in accordance with the data provided in the order.

5.-DELIVERY

The subcontracted company “Amphora” is responsible for making deliveries.

The different shipping methods you can select are:

*Home delivery

*Pickup at a Post Office of your choice.

*Pickup at any Punto Pack store of your choice.

Shipping costs are:

If you have requested delivery to a specific address, our carrier will send you an email with the link to track your shipment and resolve any issues with delivery.

In the event that you have chosen delivery to a Post Office, you have 14 days from when your order is available for delivery to pick it up. If you do not pick it up within this time frame, it will be returned to our warehouse. If you have selected to pick up the order at a Punto Pack store, you have 7 days to pick it up from when your order is available for delivery. If you do not pick it up within this time frame, it will be returned to our warehouse.

In the event that you have chosen pickup at one of our physical stores as the delivery method, the pickup period depends on the order mode

6.-RETURNS AND/OR EXCHANGES POLICY

6.1. Conditions for Returns and/or Exchanges

If you are not satisfied with your purchase once received, MOANUI allows you to exchange the size of the purchased item or return it within a period of 30 days from the receipt of the web order, provided that the product has not been used or damaged. Thus, MOANUI cannot accept exchanges or returns of used or damaged products (unless it is a defect).

In addition, you must fill out the return form (back of the delivery note) that was sent to you along with your order.

The form you download is a blank template that you must fill in with the order details as stated on the purchase invoice that we have sent you via email.

6.2. Excluded Products

We do not accept the return of sealed items that cannot be returned for reasons of health protection or hygiene, or that have been unsealed after delivery, including socks, stockings, insoles, laces, swimsuits, and bikinis.

6.3. Returns via Assigned Courier

The return of products purchased on our website can be made through the assigned Courier.

To proceed with the return to our warehouse, you must follow these steps:

Request the exchange or return explaining the reason.

After approval by the MOANUI logistics team, an automatic email with shipping information is sent to the customer.

The customer sends the package from a branch of the assigned Courier with the provided shipping code or Correos Express in the case of Spain (both are indicated in the email).

Upon receipt of the package and necessary checks, the refund or exchange is processed.

The form you download is a blank template that you must fill in with the order details as stated on the purchase invoice that we have sent you via email.

The shipping costs of the products to be returned to our warehouse will be covered by us.

For us to proceed with the return, the following conditions must be met: (i) The product must be returned unused and in perfect condition, including tags and instructions and guarantees, and (ii) You must fill out the return form (back of the delivery note). After examining the item in our warehouse, the customer service team will inform you if you are entitled to a refund of the amounts paid, and if so, we will proceed to refund the full amount of the purchase (excluding return costs if applicable) within 30 days from the product’s arrival at our warehouse and to the same bank card used for the initial purchase.

7.-RIGHT TO MODIFY THESE TERMS

MOANUI reserves the right to review and modify these conditions at any time. However, the price and other conditions of the items you have requested will not be modified during the period between your offer and its acceptance issued through the shipping confirmation, unless by law or decision of government agencies we are required to make retroactive changes to such policies, Conditions, or Privacy Policy, in which case, the possible changes will also affect orders you have previously made.

9.-APPLICABLE LAW AND JURISDICTION

The use of our website and the purchase contracts of products through said website will be governed by Spanish law.

The resolution of any kind of dispute, litigation, or discrepancy that may arise from the use of this website will be submitted to the Courts and Tribunals that are competent in accordance with the current legislation.

Likewise, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council, of May 21, 2013, which facilitates the resolution of disputes that may arise from online commerce between company and consumer, according to Article 13 of the Regulation “Member States shall ensure that traders established in their territories inform consumers about the entity or entities of alternative dispute resolution that cover such traders.”

For this purpose, the ONLINE DISPUTE RESOLUTION body is created, which will act as a neutral party and valid interlocutor between both parties, trying to avoid resorting to the courts of justice to a large extent.
